1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the SPARK LMS platform, mobile application, and related services (collectively, the "Services") operated by Softosist ("SPARK LMS", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, do not use the Services.
2. Eligibility and Account Registration
- You must provide accurate, complete, and current account information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- If you use SPARK LMS on behalf of an educational institution or organization, you represent that you are authorized to bind that entity to these Terms.
- We may suspend or terminate accounts that contain false information or violate these Terms.
3. Google Sign-In and OAuth Consent
You may sign in to SPARK LMS using your Google account. By using Google OAuth sign-in:
- You authorize us to access basic profile data you grant during consent (such as name, email, and profile image).
- We use this data solely for authentication, account creation, account recovery, and service delivery as described in our Privacy Policy.
- We do not request or access Google data beyond the scopes shown on the consent screen.
- You can revoke access at any time from your Google account permissions page; this may limit your ability to use login-related features.
4. License and Permitted Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, educational, or authorized institutional use.
You must not copy, redistribute, resell, reverse engineer, or exploit any part of the Services except as expressly permitted by law or with our written consent.
5. User Conduct and Prohibited Activities
You agree not to:
- Use the Services for unlawful, fraudulent, or misleading purposes
- Upload malware, spam, or content that disrupts platform operations
- Attempt unauthorized access to any account, network, or system
- Harass, abuse, or violate the rights of learners, instructors, or staff
- Infringe intellectual property rights or submit content you do not have rights to use
6. Courses, Content, and Intellectual Property
- All platform software, branding, and core content are owned by or licensed to Softosist and protected by applicable laws.
- Course creators and institutions retain ownership of content they upload, but grant us a license to host, process, and display it to deliver the Services.
- You may not reproduce, distribute, or publicly display paid or restricted content without authorization.
- We may remove content that violates law, third-party rights, or these Terms.
7. Payments, Billing, and Refunds
Certain courses or features may require payment. By making a purchase, you agree to pay all applicable fees, taxes, and charges shown at checkout.
- Payments are processed through authorized third-party payment gateways.
- Pricing, offers, and availability may change at any time.
- Refund eligibility, if offered, is governed by the specific course or institutional refund policy shown at the time of purchase.
8. Service Availability and Changes
We continuously improve SPARK LMS and may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.
9. Third-Party Services and Links
The Services may integrate with third-party tools (for example Google services, video conferencing tools, analytics providers, or payment processors). Your use of third-party services is subject to their terms and privacy policies, and we are not responsible for third-party content or practices.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, pose a security risk, or where required by law.
Upon termination, your right to use the Services ends immediately, but provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, and dispute terms) will continue to apply.
11. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
Educational content is for learning purposes and does not constitute legal, medical, financial, or professional advice.
12. Limitation of Liability
To the maximum extent permitted by law, Softosist and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising out of or related to your use of the Services.
13. Indemnification
You agree to defend, indemnify, and hold harmless Softosist and its affiliates from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Services, your content, or your violation of these Terms or applicable law.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts located in Pune, Maharashtra shall have exclusive jurisdiction, subject to any mandatory consumer protection rights that apply in your region.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app, website, or email. Your continued use of the Services after updated Terms become effective means you accept the revised Terms.
